Additional Disclosures Required by Specific Jurisdictions

Connecticut

Disclosures required under Connecticut General Statutes § 36a‑613(a)

(1)Prior to their account being permissioned to transact on the exchange platform, each user residing in Connecticut must electronically acknowledge the following disclosure (e.g., selecting an acknowledgment box or equivalent): WARNING: LOSSES DUE TO FRAUDULENT OR ACCIDENTAL TRANSACTIONS MAY NOT BE RECOVERABLE AND TRANSACTIONS IN VIRTUAL CURRENCY ARE IRREVERSIBLE.

(2)Virtual currency is not backed or insured by the government and accounts and value balances are not subject to Federal Deposit Insurance Corporation, National Credit Union Administration or Securities Investor Protection Corporation protections.

(3)Some virtual currency transactions shall be deemed to be made when recorded on a public ledger, which may not be the date or time when the customer initiates the virtual currency transaction.

(4)The value of virtual currency may be derived from the continued willingness of market participants to exchange fiat currency for virtual currency, which may result in the permanent and total loss of the value of a particular virtual currency, if the market for that virtual currency disappears.

(5)The volatility and unpredictability of the price of virtual currency relative to fiat currency may result in a significant loss over a short period of time.

(6)Any bond maintained by Arkham Markets America, Inc. for the benefit of its customers may not be sufficient to cover all losses incurred by such customers.

(7)Virtual currency transactions are irreversible and are used by persons seeking to defraud consumers, including, but not limited to, a person impersonating a loved one, threatening jail time, stating that a consumer’s identity has been stolen, insisting that a consumer withdraw money from the his/her bank account and purchase cryptocurrency or alleging a consumer’s personal computer has been hacked.

Disclosures required under Connecticut General Statutes § 36a‑613(b)

(1)All virtual-currency transactions initiated through your account are deemed authorized by you, and you are liable for unauthorized transactions unless caused solely by our systems.

(2)Once you initiate a deposit or withdrawal on the platform, it will be settled immediately, and you will not have any right to stop the transfer. Resting orders may be canceled prior to being matched/executed on the order book, but all orders are final once executed.

(3)Even when not required by law or government order, we may disclose information about your account to third-party service providers and affiliates who support our operations, security, compliance, and customer services, or as otherwise described in our Privacy Policy.

(4)We are required to communicate to you what customer information may be disclosed to third parties. We describe the categories of information that may be shared, and the purposes for such sharing, in our Privacy Policy, available at https://arkm.com/legal/privacy-policy.

(5)You have the right to review and consent to any material changes to our terms of service before performing any transactions on the platform after such change.
